What is Title Conversion?

And what does it mean to all of us as owners, future buyers and sellers of land in Kenya?

As you have probably heard and seen in the news, the much-anticipated title conversion process is now underway. With the first four batches of new title numbers for the county of Nairobi already released, the process is projected to be completed by early 2023.

Here are answers to some of the most asked questions on the title conversion topic.

What if there is a lien on my title?

If your title is held by a third party for security e.g. mortgage holders – You will be allowed to apply for a conversion of your title where you have used your title as security. However, you will be required to liaise with the third party (banks, hospitals, courts etc.) to facilitate the replacement process.

What documents are required for the Title Conversion process?

The following is required for the title conversion process:

1. Filled form
2. ID
3. Original title deed
4. PIN Certificate

What if there is a lien on my title?

When will the process begin?

The process has already begun. It is a phased process beginning with the county of Nairobi. As of today, (March 17th, 2021) The Ministry of Lands has already released several batches of new title numbers for Nairobi county. Other counties will follow as time progresses.

What does the conversion process entail?

There are several steps involved in the conversion process which includes waiting for the Ministry of Lands and Physical Planning to announce the dates for registering your parcels of land, lodging of complaints etc. The step by step process as well as the downloadable manual forms for this process can be found at the Ministry of Lands Website.

When will the process end?

According to the Ministry of Lands, it is expected the conversion exercise will be complete in December 2022.

How much does it cost?

The conversion process is free. You are not required to pay anything.

What will happen to my title deed(s)?

For the Ministry of Lands to produce your new replacement titles under the Land Registration Act, 2012, you will need to surrender your old title deed(s).  The old title(s) will be cancelled and placed under safe custody by the registrar.

What should I do while I wait for the the release of new numbers for my title(s)?

Make sure all your documents are in order. You may request your surveyor to check that the data has been captured correctly in the Survey Maps and/or Registry Index Maps

Are boundaries changing? Will I lose a portion of my land?

No. Land boundaries will not be affected because Registry Index Maps (RIMs) are generated from existing survey plans. The survey maps are available on request at the Ministry of Lands and Physical Planning.

I have an ongoing boundary dispute, will the title conversion fix that?

No. Land boundaries will not be affected because Registry Index Maps are generated from existing survey plans. The survey maps are available on request at the Ministry of Lands and Physical Planning. If you have a boundary dispute, we suggest hiring a licensed surveyor to investigate and establish the location of the original beacons for your plot of land.
